True Blue Review – Terms and Conditions

These Terms and Conditions ("Terms") govern the use of the True Blue Review service.

The service is provided by True Blue Review Pty Ltd ("True Blue Review", "we", "us", or "our").

By creating an account, enabling an integration, or using the service, you ("Clinic", "you", or "your") agree to these Terms.

If you do not agree, you must not use the service.


1. Nature of the Service

True Blue Review provides a communication platform used by healthcare practices to send post-appointment messages and patient feedback requests.

The service may include:

  • automated SMS messages
  • patient feedback requests
  • scheduling and sending rules
  • delivery tracking
  • opt-out handling
  • integrations with practice management systems

True Blue Review does not:

  • provide healthcare services
  • make clinical decisions
  • manage patient care
  • determine which patients should be contacted

We act solely as a technical communication tool operating under your instructions.


2. Relationship Between Parties

You remain the healthcare provider and the holder of the patient relationship.

You appoint True Blue Review as a service provider acting on your behalf to transmit communications that you authorise.

Messages sent via the service are deemed to be sent by the Clinic, not by True Blue Review independently.


3. Eligibility and Accounts

You must:

  • be a legitimate healthcare practice or authorised representative
  • be at least 18 years old
  • provide accurate account information

You are responsible for all activity under your account and for protecting login credentials.


4. Your Responsibilities (Very Important)

You are solely responsible for:

  • obtaining patient contact details lawfully
  • informing patients that communication may occur
  • obtaining any required consent
  • complying with the Privacy Act 1988 (Cth)
  • complying with the Spam Act 2003 (Cth)
  • ensuring message content is appropriate
  • responding to patient enquiries or complaints

You must not instruct us to send unlawful, misleading, harassing, or deceptive communications.

You acknowledge that True Blue Review does not control your patient consent processes.


5. Patient Communications

By using the service you authorise us to send messages to your patients using information you provide or make accessible via integrations.

You confirm:

  • the recipient is your patient
  • the message relates to their interaction with your clinic
  • the communication is expected within the clinical relationship

You remain responsible for the appropriateness and legality of communications.


6. Opt-Outs

Where supported, the system processes opt-out requests (e.g., "STOP").

You must:

  • honour opt-outs across your own systems
  • not re-upload opted-out contacts
  • not attempt to bypass suppression lists

We may block messaging to recipients who have opted out.


7. Practice Management System Integrations

If you connect a practice management system (e.g., Nookal):

  • you confirm you are authorised to grant access
  • you permit retrieval of limited patient contact data
  • you instruct us to use that data solely to send communications on your behalf

We do not access clinical notes or medical records.


8. Privacy and Data Handling

We handle information in accordance with our Privacy Policy and Data Processing Agreement.

You remain the holder of patient records and responsible for privacy compliance within your practice.


9. Fees and Billing

Fees are as listed on our website or subscription plan.

You authorise us or our payment processor to charge your payment method for subscription fees.

Prices are in Australian Dollars (AUD) and may include GST where applicable.

Subscriptions renew automatically unless cancelled before the next billing cycle.


10. Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability.

Messaging delivery may be affected by:

  • telecommunications carriers
  • mobile devices
  • network outages
  • third-party providers

11. Suspension or Termination

We may suspend or terminate access if:

  • these Terms are breached
  • unlawful messaging is attempted
  • spam complaints occur
  • there is risk to recipients or our systems
  • payment is overdue

Upon termination, messaging ceases immediately.


12. Disclaimers

The service is provided "as is".

We do not guarantee:

  • message delivery
  • patient responses
  • reviews
  • outcomes

We are not responsible for patient behaviour or feedback.


13. Limitation of Liability

To the maximum extent permitted by law:

True Blue Review is not liable for indirect or consequential loss, including loss of revenue, reputation, or patients.

Our total liability is limited to the amount paid by you for the service in the 1 month preceding the claim.

Nothing excludes rights under the Australian Consumer Law.


14. Indemnity

You agree to indemnify True Blue Review against claims arising from:

  • lack of patient consent
  • unlawful messaging
  • breach of privacy law
  • breach of spam law
  • misuse of the service
  • inaccurate patient data

15. Changes

We may update these Terms from time to time. Continued use of the service indicates acceptance of the updated Terms.


16. Governing Law

These Terms are governed by the laws of Australia.

Disputes will be handled in Queensland, Australia unless otherwise agreed.
